Terms of Service

These Terms of Service govern your access to and use of D3E Website Builder and related services provided by D3E Studio.

Agreement and acceptance

By creating an account, accessing, or using D3E Website Builder (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Subscription & Billing Policy, and Refund Policy, each incorporated by reference.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

If you do not agree to these Terms, do not use the Service.

Service description

D3E Website Builder is a software-as-a-service platform that enables you to create, edit, host, and publish websites using AI-assisted tools, templates, components, and related infrastructure.

Features available to you depend on your subscription plan and may include website generation, custom domains, SSL certificates, analytics, team collaboration, and usage-based AI tools. Plan details are described in our Subscription & Billing Policy.

Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service.

You must provide accurate registration information and maintain one account per individual or organization unless we authorize otherwise in writing.

Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You must notify us promptly at [email protected] if you suspect unauthorized access.

If you are an organization administrator, you are responsible for managing user permissions and ensuring that all users comply with these Terms.

Site project deletion

You may delete draft site projects that have not been published from the website builder. Deleting a draft permanently removes all pages, sections, builder data, and cloud-stored project data associated with that project from your account and browser.

Once a site has been published, the project cannot be deleted through the builder because we provision hosting, DNS, preview URLs, and related backend infrastructure for your live site.

Acceptable use

You agree not to use the Service in any way that violates applicable law or infringes the rights of others. Prohibited conduct includes, without limitation:

  • Publishing illegal, fraudulent, harassing, defamatory, or malicious content
  • Distributing malware, phishing pages, or spam
  • Attempting to reverse engineer, scrape, or circumvent platform security or usage limits
  • Abusing AI generation, API, or bandwidth quotas beyond fair use for your plan
  • Reselling or sublicensing the Service except as expressly permitted on eligible plans
  • Interfering with the operation, integrity, or availability of the Service

Your content and intellectual property

You retain ownership of content you create, upload, or publish through the Service ("Customer Content").

You grant D3E a worldwide, non-exclusive license to host, store, reproduce, display, and process Customer Content solely as necessary to provide, maintain, and improve the Service.

D3E retains all rights in the Service, including software, templates, documentation, branding, and underlying technology. No rights are granted to you except as expressly stated in these Terms.

Subscriptions, billing, and refunds

Paid features require an active subscription or applicable add-on purchase. Pricing, billing cycles, upgrades, downgrades, cancellations, and payment processing are governed by our Subscription & Billing Policy.

All subscription and add-on fees are non-refundable except where required by applicable law. See our Refund Policy for details.

Subscriptions renew automatically until canceled. You may cancel at any time; cancellation does not entitle you to a refund for unused time.

Third-party services

The Service integrates with third-party providers, including payment processing (Stripe), email delivery (SendGrid), and hosting infrastructure. Your use of those services may be subject to their terms and privacy policies.

D3E is not responsible for third-party services outside our reasonable control.

Service changes

We may modify, suspend, or discontinue features, plans, or limits at any time. Where changes materially affect paid subscribers, we will provide reasonable advance notice when practicable.

Beta or preview features may be offered without warranty and may be changed or withdrawn at any time.

Suspension and termination

We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or if required by law.

You may stop using the Service at any time and may request account deletion by contacting [email protected].

Upon termination, your right to use the Service ends. Provisions that by their nature should survive (including payment obligations, disclaimers, and limitations of liability) will survive.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free operation. Standard plans do not include a service-level agreement unless separately agreed in writing.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, D3E AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO D3E FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Indemnification

You will defend, indemnify, and hold harmless D3E from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your Customer Content, your use of the Service, or your violation of these Terms or applicable law.

Governing law and disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may also be communicated by email or in-app notice.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
